Welcome to Wild West Gourmet. These Terms and Conditions apply when you visit, browse, shop from, place an order through, or otherwise use www.wildwestgourmet.co.nz.

By using our website or placing an order with us, you agree to these Terms and Conditions. If you do not agree, please do not use the website or place an order.

These terms should be read alongside our Shipping Policy, Returns and Refunds Policy, Privacy Policy, and Cookie Policy.

Nothing in these Terms and Conditions limits your rights under New Zealand law, including the Consumer Guarantees Act 1993 and Fair Trading Act 1986 where they apply.

1. About us

Wild West Gourmet is a New Zealand business supplying small-batch sauces, relishes, chutneys, seasonings, flavoured salts, and related products.

Our website currently sells to customers within New Zealand only. International enquiries are welcome by email, but international ordering is not available through the website unless we agree otherwise in writing.

2. Using our website

You may use our website for personal shopping, browsing, recipes, product information, stockist information, event information, and general Wild West Gourmet content.

You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with website security, scrape content, or use the website in a way that is unlawful, harmful, misleading, or disruptive.

We aim to keep the website available and secure, but we do not guarantee uninterrupted or error-free access. We may update, suspend, withdraw, or change parts of the website from time to time.

3. Product information

We do our best to keep product descriptions, pricing, stock availability, ingredients, allergen information, and other website content accurate and up to date.

Because our products are small-batch, there may be natural variations in colour, texture, batch appearance, packaging, labels, or presentation from time to time. Product images are provided as a guide.

Please read product labels carefully before use. Our products may contain, or be made in an environment where they may come into contact with, allergens. If you have allergies, intolerances, dietary restrictions, or specific ingredient concerns, please contact us before ordering.

You are responsible for checking that a product is suitable for your needs before purchasing or consuming it.

We will not knowingly make misleading product, pricing, promotional, or availability claims.

4. Orders

When you place an order through our website, you are making an offer to purchase the selected products at the prices shown at checkout.

We may accept or decline an order at our discretion, including where:

  • a product is unavailable

  • payment has not been received

  • delivery details are incomplete or incorrect

  • there has been a genuine pricing, stock, or website error

  • we reasonably believe the order may be fraudulent, unlawful, or otherwise unsuitable for fulfilment

Once your order has been accepted, we will process it as soon as reasonably possible.

5. Pricing

All prices on our website are in New Zealand dollars.

Prices may change without notice. The price you pay is the price shown at checkout at the time you place your order, unless there has been a genuine error.

Delivery charges are shown at checkout and form part of your total order cost.

6. Payment

We accept payment by credit card and internet banking.

Credit card payments are processed securely by our payment provider. We do not store your full credit card details on our own systems.

Orders paid by internet banking will be processed once payment has been received and matched to your order. Please use your order number as the payment reference where possible. Delays in payment or missing payment references may delay dispatch.

7. Delivery

We deliver within New Zealand only.

We do not offer click and collect from our premises. Please do not arrive at our premises to collect an order unless we have expressly arranged this with you in writing.

Please provide a complete and accurate delivery address at checkout, including any rural delivery details, business names, unit numbers, access instructions, or other information the courier may need.

We are not responsible for delays, failed deliveries, or additional costs caused by incorrect or incomplete delivery details supplied by the customer.

Delivery timeframes are estimates only and may vary depending on your location, courier network conditions, rural delivery, weather events, public holidays, or other delays outside our reasonable control.

Shipping charges are shown at checkout and may vary based on delivery region, order size, weight, packaging, or courier requirements.

8. Region selection at checkout

Our website shipping rates rely on the delivery details entered at checkout. To help the website calculate shipping correctly, please make sure you select the correct State/Province/Region field when entering your delivery address.

If the region field is not selected, shipping options may not display correctly and you may be unable to complete checkout.

9. Risk and delivery

We package orders carefully for courier delivery.

Risk in the products passes to you once the order has been delivered to the address you provided, unless the issue is caused by our error or a courier damage issue that is accepted under our returns and refunds process.

If a parcel appears delayed, missing, damaged, or misdirected, we will do our best to assist, but courier delivery times are not fully within our control once a parcel has been collected.

10. Breakages or damage during shipping

If your order arrives damaged or broken, please contact us as soon as possible at:

Please include:

  • your order number

  • your full name and contact details

  • photographs of the damaged product

  • photographs of the parcel, outer packaging, inner packaging, and courier label

  • a description of the damage

  • the product name and quantity affected

Please keep the damaged product and packaging until we have reviewed the issue, as the courier may require evidence.

Where a remedy is appropriate, we may offer a replacement, refund, credit, or another fair resolution depending on the circumstances and applicable law.

11. Missing or incorrect items

If your order is missing an item or you believe the wrong item has been sent, please contact hello@wildwestgourmet.co.nz as soon as possible.

Please include your order number, photos of what you received, and a description of the issue.

If we have made an error, we will work with you to provide a fair resolution, which may include sending the correct item, replacing the missing item, providing a refund, issuing a credit, or another appropriate remedy.

12. Returns and refunds

Please choose carefully before completing your purchase.

We do not offer returns, exchanges, refunds, or credits for change of mind. Change of mind includes situations where:

  • you no longer want the product

  • you ordered the wrong item

  • your circumstances have changed

  • you found a cheaper product elsewhere

  • you decided the product is not to your personal taste, provided the product is not faulty or otherwise in breach of applicable consumer guarantees

Because we sell food products, we generally cannot accept returned products unless we have specifically asked you to return them. This is for food safety and quality reasons.

Please do not send products back to us without contacting us first. Unauthorised returns may not be accepted or refunded.

Nothing in this section limits your rights under New Zealand law. If a product does not meet a guarantee that applies under the Consumer Guarantees Act or another applicable law, we will provide an appropriate remedy as required. Depending on the situation, this may include replacement, refund, credit, or another fair resolution.

13. Product quality issues

If you believe there is a product quality issue, please contact hello@wildwestgourmet.co.nz as soon as possible.

Please include:

  • your order number, if purchased online

  • the product name

  • the batch number, if shown

  • the best before date

  • photographs of the product, label, lid, jar or bottle, and any visible issue

  • a full description of the issue, including when it was first noticed

  • details of how the product was stored and handled after purchase

  • your full name and contact details

This information helps us investigate properly, identify the batch, and resolve the matter fairly.

Once we receive the required information, we will assess the issue and contact you with the next steps. We may ask questions or request further photos so we can understand what has happened.

Where a remedy is appropriate, we may offer a replacement, refund, credit, or another fair resolution depending on the circumstances and applicable law.

14. Refund method

Approved refunds will usually be made using the original payment method where possible.

Refund timing may vary depending on the payment provider or bank processing times.

15. Gifts and products bought from stockists

If a product was purchased from one of our stockists or another retailer, please contact that retailer first with your proof of purchase.

If needed, they can contact us for support.

16. Market, pop-up, and in-person sales

These Terms and Conditions also apply, where relevant, to products purchased directly from us at markets, pop-ups, tastings, workshops, events, or other in-person sales.

For in-person purchases, payment is due at the time of purchase unless we have agreed otherwise.

Please check your items before leaving where practical. If you later discover a product quality issue, breakage, missing item, or other concern, please contact us as soon as possible with the product name, batch number if available, proof of purchase if available, photos where relevant, and a clear description of the issue.

Change-of-mind returns are not accepted for in-person food purchases, but nothing in this section limits your rights under New Zealand law.

17. Promotions, bundles, and discount codes

From time to time, we may offer promotions, discount codes, bundles, giveaways, or limited-time offers.

These may be subject to additional terms, expiry dates, minimum spend requirements, stock availability, one-use limits, customer limits, or exclusions.

We may correct, withdraw, or amend a promotion if there has been a genuine error, misuse, technical issue, or circumstances outside our reasonable control.

Unless stated otherwise, discount codes cannot be exchanged for cash, applied retrospectively, combined with other offers, or used after their expiry date.

18. Gourmet for Good fundraising sales

Where products are purchased through, or in connection with, a Wild West Gourmet fundraising campaign, additional campaign terms may apply.

Fundraising contributions, eligible products, donation percentages, campaign timeframes, freight treatment, and payment arrangements will be explained in the relevant fundraising information.

Unless stated otherwise, freight is not included when calculating fundraising contributions.

Nothing in this section limits customer rights under New Zealand law.

19. Business, wholesale, food service, and trade purchases

These Terms and Conditions are primarily intended for website and consumer purchases.

Where products are purchased for business use, resale, food service, manufacturing, wholesale, or other commercial purposes, additional trade terms may apply.

To the extent permitted by law, and where agreed in writing, the Consumer Guarantees Act may not apply to business purchases.

20. Intellectual property

All website content, including text, photographs, product names, graphics, branding, recipes, and other materials, belongs to Wild West Gourmet or is used with permission.

You may view and use our website for personal shopping and general information.

You must not copy, reproduce, modify, publish, or commercially use our content without our prior written permission.

You may share links to our website or social media content in a fair and respectful way, provided you do not suggest any endorsement, partnership, or approval unless we have agreed to this.

21. Links to other websites

Our website may include links to third-party websites, platforms, payment providers, social media platforms, embedded content, or services.

These are provided for convenience. We are not responsible for the content, privacy practices, security, availability, or terms of those third-party sites.

22. Privacy

When you place an order, contact us, subscribe to our emails, or use our website, we may collect and use personal information to process orders, receive payment, arrange delivery, provide customer support, manage product quality issues, send service messages, send marketing where permitted, and meet legal, tax, accounting, food safety, record-keeping, and regulatory obligations.

Nothing in these Terms and Conditions limits your rights under New Zealand law, including the Consumer Guarantees Act 1993 and Fair Trading Act 1986 where they apply.

To the fullest extent permitted by law, Wild West Gourmet is not liable for indirect, incidental, consequential, or special loss arising from your use of the website or products, except where liability cannot be excluded by law.

25. Changes to these Terms and Conditions

We may update these Terms and Conditions from time to time.

The updated version will be posted on our website with the effective date.

Continued use of the website after an update means you accept the updated terms.
